Terms of Service — Iron & Clover Motorcycle Mercantile

1) Who We Are
This website is operated by Iron & Clover Motorcycle Mercantile, a DBA of Iron & Clover, LLC (“Iron & Clover,” “we,” “us,” “our”). By visiting our site and/or purchasing from us, you agree to these Terms of Service (“Terms”).
Our store runs on Shopify Inc., which provides the e-commerce platform we use to sell products and services.
2) Your Agreement
By accessing any part of the site or buying from us, you accept these Terms and all policies referenced here (like our Privacy Policy and Return & Refund Policy). If you don’t agree, please don’t use the site.
We may update these Terms at any time by posting a new version here. Your continued use means you accept the changes.
3) Age & Lawful Use
You must be the age of majority in your state/province (or have a parent/guardian’s consent for dependent use). You agree not to use the site or products for any unlawful or unauthorized purpose and to follow all applicable laws.
4) Account & Order Info
Provide current, complete, and accurate info for purchases and accounts, and keep it updated so we can process orders and contact you as needed. We may refuse, limit, or cancel orders (for example, suspected resellers, duplicate info, fraud risk, or unusual quantities). If we change or cancel an order, we’ll try to notify you using the info provided at checkout.
5) Products, Availability & Pricing
We work hard to display products and colors accurately but can’t guarantee your screen’s display. We may limit quantities, discontinue items, or change product info or prices at any time. If we spot an error (description, pricing, shipping, availability), we may correct it and/or cancel orders affected by it.
6) Shipping, Risk of Loss & Taxes
Shipping timelines shown are estimates. Risk of loss passes to you when the carrier accepts the shipment. You’re responsible for any applicable sales/use taxes and duties. See our Shipping Policy for details.
7) Returns & Exchanges
Returns are handled per our Return & Refund Policy (30 days from delivery, customer-paid return shipping, 10% restocking fee, and listed exceptions). Please review that policy before sending anything back.
8) Content You Submit
If you share reviews, photos, or other content (“Comments”), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, translate, and distribute them in any media. Don’t submit unlawful, infringing, defamatory, or malicious content, or anything containing viruses/malware. You’re responsible for the Comments you submit.
9) Third-Party Tools & Links
We may offer access to third-party tools or link to third-party sites. They’re provided “as is” and “as available.” We don’t control or endorse them and aren’t liable for your use. Review third-party terms and policies before engaging with them.
10) Prohibited Uses
You agree not to use the site or its content to:
break laws or infringe IP rights;
harass, abuse, defame, discriminate, or spread hateful content;
submit false or misleading info;
upload viruses, malware, or code that affects the site or the internet;
collect personal info of others or engage in spamming/scraping;
circumvent security features.
We may suspend or terminate access for violations.
11) Intellectual Property
All trademarks, logos, service marks, product names, graphics, text, photos, and site design are owned by or licensed to Iron & Clover and are protected by law. You may not use them without our written permission.
12) Service & Price Changes
We may modify or discontinue the site (or any part of it) without notice. We aren’t liable to you or others for any modification, price change, suspension, or discontinuance.
13) Warranties & Disclaimers
The site and all products/services are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, title, or non-infringement). We do not guarantee uninterrupted, timely, secure, or error-free operation.
14) Limitation of Liability
To the maximum extent permitted by law, Iron & Clover (and our owners, employees, contractors, suppliers, and service providers) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or replacement costs, arising from your use of the site or products, even if advised of the possibility. Where limits aren’t allowed, our liability is limited to the amount you paid us for the order giving rise to the claim.
15) Indemnification
You agree to indemnify and hold Iron & Clover and our affiliates, officers, directors, employees, agents, contractors, suppliers, and licensors harmless from any claim or demand (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of law, or your infringement of third-party rights.
16) Severability & No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions still apply. Our failure to enforce a right isn’t a waiver of that right.
17) Assignment
We may assign or transfer our rights and obligations under these Terms. You may not assign your rights or obligations without our prior written consent.
18) Force Majeure
We aren’t liable for delays or failures caused by events beyond our reasonable control (e.g., acts of God, labor disputes, shortages, transportation or utility failures, or government actions).
19) Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Virginia and the United States, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of state or federal courts located in Bedford County, Virginia (or the nearest appropriate venue).
20) Entire Agreement
These Terms, together with our referenced policies (Privacy, Return & Refund, Shipping), are the entire agreement between you and Iron & Clover regarding your use of the site and purchases, and supersede prior agreements.
